O ASSÉDIO MORAL ORGANIZACIONAL NO AMBIENTE DE TRABALHO: DANO MORAL COLETIVO?
Abstract
Moral harrasment in working relationships implies moral damages to those who suffer it and which must be repaired through indemnity. Fundamental rights violated often transcend the individual sphere of the worker and reach the interests of the collective. Abusive conduct perpetrated by corporate management policy constitutes organizational moral harassment, because the employer´s culture is based on offensive, humiliating and vexatious practices that degrade the work environment. Compensating the suffering of the offended and punish those who exercise it, so that they are discouraged from commiting the ilegal act again, are purposes of indemnity for moral damages. When affronting the rights of the community, organizational moral harassment causes collective moral damages, whose reparation has been accepted by the higher courts.
